Moscow Arbitration Court finds RSCC tender committee actions and decisions well-founded and legally proper

The matter in dispute at the open hearing was an action brought by JSC ISS – Reshetnev Company seeking to invalidate the results of RSCC’s tender concerning the Express-AMU2 satellite.

The matter in dispute at the open hearing was an action brought by JSC ISS – Reshetnev Company seeking to invalidate (i) the record of RSCC's open tender for the right to conclude a contract for design, development, manufacture, delivery, integration, pre-launch processing, in-orbit testing, commissioning and in-orbit support for the duration of the Express-AMU2 satellite service life, and to invalidate (ii)  the open tender for the right to conclude a contract for design, development, manufacture, delivery, integration, pre-launch processing, in-orbit testing, commissioning and in-orbit support for the duration of the Express-AMU2 satellite service life. In other words, JSC ISS, acting through arbitration, was attempting to cancel the results of the afore-mentioned tender.

Having failed to find any inconsistency of RSCC’s tender documentation and procedures with applicable Russian law, the Moscow Arbitration Court has dismissed the claim brought by JSC ISS – Reshetnev Company.
